Terms of Use

These Terms of Use apply to your use of the No Limits Training Diary, including the web application available through No Limits Health Clubs.

By creating an account or using the Training Diary, you agree to these Terms.

These are the terms for the Training Diary app. They are separate from No Limits Health Clubs gym membership terms, and neither one changes the other.

1. About the Training Diary

The No Limits Training Diary is a fitness training and workout-recording application operated by No Limits Health Clubs ("No Limits", "we", "us" or "our").

The Training Diary provides features including workout programs, exercise information, workout logging, personal best tracking, body measurement tracking, body-composition estimates, training history, timers, plate calculations and other fitness-related tools.

The Training Diary may be used by No Limits members and by people who train at other gyms.

Use of the Training Diary does not, by itself, create a No Limits Health Clubs gym membership.

2. Your account

You may need to create an account to use some features.

You are responsible for providing accurate information and for maintaining the security of your account and login credentials.

You must not:

3. Free and paid access

The No Limits Training Diary is currently available free of charge to everybody. You do not need to be a No Limits member, and the whole app — programs, account sync, unlimited history and everything else — is provided without payment.

A small number of people hold a subscription purchased before the Training Diary became free. Those subscriptions remain as purchased, can be cancelled at any time, and new charges are not taken merely because the app is now free.

We may introduce optional paid features or subscription plans in the future. If we do, the price, billing frequency, renewal conditions and applicable terms will be shown before you make any purchase.

You will not be charged merely because a free feature later becomes part of a paid offering. Any future paid service will require you to actively agree to the applicable purchase or subscription terms.

Sections 4 to 8 below describe how subscriptions, trials, promotional access, cancellation and refunds would work. They apply to any paid service we offer — including a subscription held from before the Training Diary became free — and are kept here so the terms of a purchase are visible before one is possible rather than appearing at the moment one is asked for.

We may change, suspend or discontinue features over time, subject to applicable Australian law. If a change materially affects a paid service you have already purchased, your rights under applicable Australian consumer law continue to apply.

4. Subscriptions

This section applies to a recurring Training Diary subscription you hold from before the Training Diary became free, and to any we may offer in the future.

Where a recurring subscription is purchased, the price and billing frequency will be shown before you confirm your purchase.

Subscriptions may be offered on a monthly or annual basis.

Unless stated otherwise before purchase, recurring subscriptions automatically renew until cancelled.

Payment processing is provided by Stripe. No Limits does not store your complete credit or debit card details.

You authorise the applicable subscription charge to be made using the payment method you provide through Stripe.

5. Free trials

We may offer eligible users a free trial.

The duration and conditions of a trial will be displayed when the offer is made.

A trial may be limited to one per person or account.

Where a trial requires payment details and will automatically convert to a paid subscription, this will be disclosed before you start the trial.

Where a trial does not automatically convert to a paid subscription, you will need to actively purchase a subscription to continue using paid features after the trial ends.

We may prevent repeated or abusive use of introductory trials.

6. Founder and promotional access

From time to time, we may provide founder access, promotional access, redemption codes or complimentary access.

These offers may be limited in number, have an expiry date, be restricted to one redemption per person or account, provide access for a specified period, or have other conditions disclosed with the offer.

Unless expressly stated otherwise, promotional or complimentary access has no cash value and cannot be transferred or exchanged for cash.

Any paid Founder offer will be governed by the specific conditions displayed when that offer is purchased.

7. Cancelling a subscription

This section applies to a recurring Training Diary subscription you hold from before the Training Diary became free, and to any we may offer in the future.

You may cancel a recurring Training Diary subscription using the subscription-management options provided through the Training Diary.

Cancellation prevents future recurring charges.

Unless otherwise required by law or expressly stated at the time of purchase, cancellation ordinarily takes effect at the end of your current paid billing period and you may continue using the applicable paid features until that period expires.

Deleting your Training Diary account is separate from simply cancelling your subscription.

Where an account with an active recurring subscription is deleted, our system will attempt to cancel the associated recurring subscription before completing deletion.

If we cannot safely confirm the subscription's status or complete the required cancellation, account deletion may be temporarily refused so that you are not left with an active subscription attached to a deleted account.

8. Refunds

Payments are generally non-refundable merely because you change your mind or stop using the Training Diary during a paid billing period.

However, nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where you are entitled to a refund or other remedy under applicable law, these Terms do not affect that entitlement.

9. Fitness and exercise information

The Training Diary is a training-recording and informational tool.

It is not medical advice, diagnosis, treatment or individual medical supervision.

Exercise descriptions, programs, suggested workouts and other information are general in nature and may not be appropriate for every person.

You are responsible for deciding whether an exercise or training program is suitable for you.

If you have an injury, medical condition, are pregnant, have concerns about exercise or are unsure whether you should undertake a particular activity, seek appropriate advice from a qualified health professional before doing so — particularly before beginning or materially changing an exercise program.

Stop exercising and seek appropriate assistance if you experience symptoms that concern you.

Some programs in the Training Diary — including the SchembriPT Bodybuilding Collection — are historical programs written by a third-party coach, Luke Schembri of SchembriPT, for another individual, and are published with acknowledgement and attribution. They are general training information and are not written for you personally, are not a consultation, and are not a substitute for individual coaching or medical advice. 10. Training results

The Training Diary may display calculations, progress information, personal bests, estimated values, training history and other information based on information you enter.

Body-composition figures the Training Diary shows — including estimated body fat and related measures — are estimates calculated from measurements you enter using published estimation formulas. They are not medical measurements, clinical assessments or diagnoses, and they can differ materially from professional measurement methods.

Results vary between individuals.

We do not guarantee that using the Training Diary or following a particular program will produce any particular improvement in strength, fitness, body composition, weight or health.

11. Information you enter

You are responsible for information you enter into the Training Diary.

You should not enter information that belongs to another person without authority, is unlawful, infringes another person's rights, or contains malicious code or material intended to interfere with the service.

You retain ownership of information that you create and enter into your account, subject to the permissions reasonably necessary for us to operate the Training Diary.

12. Progress photos and personal information

How we collect, use, store and protect personal information is explained in the No Limits Training Diary Privacy Policy.

Where the Training Diary provides progress-photo functionality that stores photographs locally on your device rather than uploading them to our servers, those photographs remain subject to the security and storage controls of your device and browser.

You are responsible for protecting access to your device.

13. Account deletion

You may request deletion of your Training Diary account using the account controls provided within the application.

Account deletion is permanent.

When deletion is completed, information associated with your account that is designated for deletion will be removed in accordance with our Privacy Policy and applicable legal requirements.

Some limited information may need to be retained where required by law, for legitimate financial or transaction records, fraud prevention, dispute resolution or other lawful purposes.

Deleting your Training Diary account does not cancel or terminate a separate No Limits Health Clubs gym membership.

14. Availability of the Training Diary

We aim to keep the Training Diary available and operating reliably, but uninterrupted availability cannot be guaranteed.

The service may occasionally be unavailable because of maintenance, software updates, internet or hosting outages, third-party service interruptions, security incidents or circumstances outside our reasonable control.

Where reasonably practical, we will work to restore the service.

15. Changes to the Training Diary

We may update, improve, replace or discontinue features as the Training Diary develops.

We may also update these Terms.

If a change materially affects an existing paid subscription or your rights, we will provide notice where required by law.

The current version of these Terms will be made available through the Training Diary.

16. Intellectual property

The Training Diary, including its software, branding, design, exercise library, written content, graphics and other materials supplied by No Limits, is owned by or licensed to No Limits and is protected by applicable intellectual-property laws.

Your right to use the Training Diary is personal, limited and non-transferable.

You must not copy, reproduce, sell, redistribute or commercially exploit substantial parts of the Training Diary without our permission, except where permitted by law.

17. Suspension or termination

We may suspend or terminate access where we reasonably believe an account is being used unlawfully, fraudulently, to interfere with the service, to bypass payment or security controls, to access another person's information, or in serious or repeated breach of these Terms.

Where appropriate, we may provide an opportunity to resolve the issue before termination.

Nothing in this section affects rights you may have under applicable law.

18. Third-party services

The Training Diary relies on third-party technology providers to operate parts of the service.

These may include services for hosting, database infrastructure, authentication and payment processing.

Third-party services may occasionally experience outages or other technical problems outside our direct control.

19. Liability and Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified.

To the maximum extent permitted by law, No Limits is not responsible for indirect or consequential loss arising solely from your use of, or inability to use, the Training Diary where such liability may lawfully be excluded.

You remain responsible for exercising reasonable care when undertaking physical exercise.

20. Governing law

These Terms are governed by the laws of Victoria, Australia.

You and No Limits submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
